These Terms & Conditions (“Terms”) constitute a legally binding agreement between You (“User”, “Farmer”, “Intermediary”, “Agent”,) and FarmerPay Fintech Private Limited (“Company”, “We”, “Us”, “Our”) governing Your access to and use of the FarmerPay Mobile Application and the FarmerPay website (collectively referred to as the “Platform”).
By downloading, installing, accessing, or using the Platform in any form, You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree with any part of these Terms, You must refrain from using the Platform.
The Platform is designed to support agriculture, livestock, fisheries, financial access, advisory, and operational enablement for farmers, intermediaries, and authorized administrative users. Your use of the Platform is also governed by Our Privacy Policy, which forms an integral part of these Terms.
These Terms apply exclusively to the FarmerPay Mobile Application used by Farmers, Intermediaries/Agents, and the FarmerPay Agent, Bank & Admin Dashboard used by authorized administrators for monitoring, verification, loan/insurance processing, and system operations. Any future extensions of the Platform shall be governed by supplemental terms issued from time to time.
To access and use the Platform, You must be a natural person who is at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872. By using the Platform, You represent and warrant that all information provided during registration or usage is accurate, complete, and truthful.
Intermediaries, Agents, and Admin Users accessing special-purpose modules represent that they are officially authorized by the Company or by an approved institution to perform their designated roles. You further confirm that You will use the Platform only for lawful agricultural, financial, and operational purposes and not for any fraudulent, harmful, or misleading activity.
To use the Platform, You must create an account through the mobile application. The registration process requires You to provide Your mobile number and complete an OTP verification. Upon successful verification, You must enter Your name, demographic details, and select Your primary and secondary livelihood activities.
Intermediaries/Agents must additionally upload mandatory identity documents, including Aadhaar and PAN, along with village lists or operational areas. Access to the Intermediary Dashboard is granted only after administrative verification. By registering, You undertake to maintain accurate and updated information at all times. The Company reserves the right to suspend or terminate accounts that contain incorrect or falsified information.
The Platform enables a wide range of agricultural and financial enablement services, which may include farmer onboarding, TRUST score calculation, loan and insurance discovery and application, farm/field addition, livestock and fishery management, advisory, crop intelligence through ROOTS, government scheme viewing, weather updates, mandi prices, profitability insights, and operational workflows for administrators. The services offered are informational and facilitation-based in nature and may be modified or removed without prior notice.
FarmerPay Fintech Private Limited is not a bank, NBFC, lender, insurer, financial advisor, or agent of any bank/financial institution. The Platform merely aggregates information about loan and insurance offerings and enables Users to submit requests for onward processing to authorized financial institutions. All financial decisions are made by the respective financial institution. FarmerPay does not store or request sensitive financial credentials such as bank passwords, UPI PINs, Aadhaar OTPs, or similar confidential information.
You agree to use the services ethically, responsibly, and lawfully. You must refrain from uploading false or misleading information, fake documents, manipulated data, fraudulent identity, or any content that violates applicable laws. You are responsible for maintaining the confidentiality of Your login credentials and restricting unauthorized access to Your device. Any activity conducted under Your account will be treated as Your own.
Your data is processed in accordance with the FarmerPay Privacy Policy, developed in compliance with the Digital Personal Data Protection Act, 2023. FarmerPay does not store or retain bank passwords, UPI PINs, Aadhaar OTPs, or similar confidential financial data. Information such as age, identity documents, land ownership details, geolocation, cropping patterns, livestock and fisheries data, and income-related information is collected only with Your consent and is stored on secure Indian servers. Personal data is shared only with Your explicit consent and strictly with authorized institutions.
All content, including text, graphics, icons, processes, algorithms, advisory modules, datasets, software code, logos, brand elements, and proprietary tools available on the Platform, belong exclusively to FarmerPay Fintech Private Limited. Users are prohibited from copying, modifying, reverse-engineering, distributing, or creating derivative works from the Platform or its content.
You shall refrain from using the Platform for fraudulent loan or insurance applications, submitting forged documents, spoofing location or farm boundaries, attempting to bypass system permissions, manipulating financial eligibility data, engaging in hacking or server attacks, or uploading harmful or illegal content. Violation grants the Company the right to suspend or terminate access and pursue legal remedies.
The Platform integrates with services like DigiLocker, Aadhaar authentication utilities, mandi data providers, weather data sources, map providers, government APIs, and financial institutions. FarmerPay does not control third-party availability or accuracy and is not liable for outages or inaccuracies arising from them.
FarmerPay strives to maintain continuous service but does not guarantee uninterrupted availability. Scheduled maintenance, system failures, network issues, and third-party outages may affect access. FarmerPay shall not be liable for losses incurred due to downtime or inability to access the Platform.
To the maximum extent permitted under applicable Indian law, FarmerPay shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from use or inability to use the Platform, loan rejection, market fluctuations, crop losses, weather impacts, inaccuracies in mandi prices, errors in user-submitted data, third-party API failures, or business losses. Decisions based on the Platform’s output remain the User’s responsibility.
You agree to indemnify and hold harmless FarmerPay, its directors, employees, affiliates, and partners from any claims, losses, damages, liabilities, costs, or expenses arising from violations of these Terms, misuse of the Platform, fraudulent submissions, breach of law or third-party rights, or upload of illegal content. This indemnity survives termination of Your use of the Platform.
FarmerPay reserves the right to suspend or terminate accounts without notice in cases of fraud, unauthorized system interference, legal violations, threats to system integrity, or non-cooperation during verification. Users may request account deletion by contacting support. On deletion, data is anonymized or erased as per the Privacy Policy.
The Company may update or modify these Terms at its discretion. Updated versions will be published within the application, and continued usage shall be considered acceptance of the revised Terms.
These Terms shall be governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi.
